Terms of Use & EULA

1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User") and Hamza Benmalek ("Developer," "we," "us," or "our") governing your use of the Studiq mobile application ("App") on iOS and Android devices.

By downloading, installing, or using Studiq, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. End User License Agreement (EULA)

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Studiq on devices you own or control, solely for personal, non-commercial educational purposes.

For apps distributed via the Apple App Store, the terms of Apple's standard Licensed Application End User License Agreement also apply and are incorporated herein by reference. In the event of a conflict between Apple's EULA and these Terms, Apple's EULA will govern.

You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer, decompile, or disassemble the App
• Use the App for any commercial purpose or for any public display
• Remove any proprietary notices or labels on the App
• Use the App to develop a competing product or service

3. Studiq Premium — Subscription Terms

3.1 What's Included in Studiq Premium

Studiq Premium ("Premium") is an auto-renewable subscription that unlocks the following features:

• Unlimited quiz and flashcard generation from documents, images, and text
• Advanced AI-powered question types and difficulty levels
• Unlimited document uploads (PDF, image, text)
• Ad-free experience
• Priority access to new features
• Cloud sync across multiple devices

Free tier users have access to a limited number of quiz generations per day.

3.2 Billing and Auto-Renewal

Studiq Premium is offered as an auto-renewable subscription. By subscribing, you agree to the following:

• Payment will be charged to your Apple ID or Google Play account at the confirmation of purchase.
• Your subscription automatically renews at the end of each billing period (monthly or annual) unless you cancel at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current subscription period.
• The renewal price will be the same as the original subscription price, unless we notify you otherwise in advance.
• You can manage and cancel your subscription at any time in your device's account settings (App Store → Apple ID → Subscriptions, or Google Play → Subscriptions).
• No refund will be provided for the unused portion of a subscription period when you cancel mid-period, except as required by applicable law.

3.3 Free Trials

When a free trial is offered:

• The free trial begins when you initiate it and lasts for the duration specified at the time of the offer.
• Any unused portion of a free trial period will be forfeited when you purchase a Premium subscription.
• If you do not cancel before the free trial ends, your subscription will automatically begin and your payment method will be charged.

3.4 Cancellation

To cancel your subscription:

• iOS: Go to Settings → [Your Name] → Subscriptions → Studiq → Cancel Subscription
• Android: Go to Google Play → Profile → Payments & subscriptions → Subscriptions → Studiq → Cancel

Cancellation takes effect at the end of the current billing period. You will retain access to Premium features until that date.

3.5 Price Changes

We reserve the right to change subscription prices. If we change the price of your subscription, we will notify you in advance. Your continued use of the subscription after the price change constitutes your agreement to the new price.

4. User Content

Studiq allows you to upload documents, images, and text ("User Content") to generate quizzes and flashcards. You retain all ownership rights to your User Content.

By uploading User Content, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the App's services to you. We do not use your content to train AI models without your explicit consent.

You are solely responsible for ensuring you have the right to upload any content. You may not upload content that:

• Infringes any third-party copyright, trademark, or intellectual property rights
• Contains illegal, harmful, or offensive material
• Violates any applicable law or regulation

5. AI-Generated Content

Studiq uses AI technology (Google Gemini AI) to generate quizzes and flashcards from your uploaded content. You acknowledge that:

• AI-generated content may not always be accurate, complete, or appropriate for your specific educational context.
• You should review all AI-generated content before using it for educational purposes.
• We are not responsible for errors, inaccuracies, or omissions in AI-generated content.
• AI-generated quizzes and flashcards should supplement, not replace, proper study materials.

6. Intellectual Property

The App, including its design, code, features, and all content created by us (excluding User Content), is owned by Hamza Benmalek and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

7. Privacy

Your use of Studiq is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our data practices.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any AI-generated content.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, providing in-app notification. Your continued use of Studiq after changes become effective constitutes acceptance of the revised Terms.

11. Termination

We may suspend or terminate your access to Studiq at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason.

Upon termination, your license to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Morocco, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Morocco.
